Terms of Service
These Terms of Service (hereinafter referred to as “these Terms”) set forth the conditions for using the online shop operated by Ishida Shoten Co., Ltd. (hereinafter referred to as “the Company”).
Users shall use the online shop (hereinafter referred to as “the Shop”) upon agreeing to these Terms.
Article 1 (Scope of Application)
1. These Terms apply to all actions related to the use of the Shop.
2. Various guidelines, notices, and policies posted by the Company on the Shop constitute a part of these Terms.
3. Users are deemed to have agreed to these Terms upon using the Shop.
Article 2 (Definitions)
The definitions of terms used in these Terms are as follows:
(1) “Service”: The sale of products and related services provided through the Shop
(2) “Products”: Gemstones, jewelry, and other goods sold through the Shop
(3) “User”: Any individual or corporation using the Shop
Article 3 (Changes to These Terms)
1. The Company may revise these Terms whenever necessary.
2. Revised Terms take effect at the time they are posted on the Shop.
Article 4 (Usage Environment)
1. Users shall prepare and maintain, at their own responsibility, the communication environment and equipment necessary to use the Shop.
2. The Company shall not be liable for any damages resulting from communication failures or system malfunctions.
Article 5 (Use by Minors)
Minors shall obtain the consent of a parent or legal guardian before using the Shop.
Article 6 (Prohibited Acts)
Users shall not engage in the following acts:
(1) Acts that violate laws or public order and morals
(2) Acts that infringe on the rights of the Company or third parties
(3) Orders or use of the Service through false information or fraudulent methods
(4) Unauthorized use of credit cards
(5) Acts deemed by the Company to be for resale purposes
(6) Acts that interfere with the operation of the Shop
(7) Any other acts the Company deems inappropriate
Article 7 (Purchase of Products)
1. When a user clicks the order confirmation button, the user is deemed to have made a purchase application.
2. A sales contract is established when the Company ships the product and sends a shipment confirmation email or similar notice.
3. The Company may cancel the order or terminate the contract in the following cases:
(1) When a violation of these Terms is found
(2) When the payment process is not completed
(3) When stock shortages, pricing errors, or other unavoidable issues are discovered
(4) When fraudulent ordering is suspected
Article 8 (Prices and Payment Methods)
1. Product prices shall be as displayed on the Shop.
2. Payment methods shall be those designated by the Shop.
3. Disputes related to payment shall be resolved by the user at their own responsibility.
Article 9 (Shipping, International Shipping, Customs Duties)
1. After confirming payment, the Company will promptly ship the product using its designated method.
2. Delivery times vary by destination country, customs processes, and courier conditions. The Company is not liable for delays unless attributable to its own fault.
3. Customs duties, import taxes, and related fees incurred during international shipping shall be borne by the user.
4. The Company shall not be liable for delays, seizures, or confiscation by customs unless caused by intent or gross negligence of the Company.
5. Risk of loss or damage to products transfers to the user at the time the product is handed over to the shipping carrier.
Article 10 (Returns, Exchanges, and Cancellations)
1. Due to the nature of the products, the Company does not accept cancellations, returns, or exchanges for user convenience.
2. Returns or exchanges will be accepted only in the following cases:
(1) When a significant defect attributable to the Company is found in the product
(2) When a product different from the order arrives
3. Users shall contact the Company within 7 days of receiving the product, and the Company will respond after verifying the facts.
4. Variations in color, inclusions, or other natural characteristics of gemstones do not constitute defects.
Article 11 (Product Description and Characteristics of Natural Gemstones)
1. Differences between product images and actual product colors may occur, and the Company does not guarantee exact matching.
2. Natural gemstones vary individually, and such differences do not constitute grounds for returns.
Article 12 (Intellectual Property Rights)
All intellectual property rights, including copyrights, related to content posted on the Shop belong to the Company or rightful owners.
Article 13 (Modification, Suspension, or Termination of Services)
The Company may modify, suspend, or terminate all or part of the Shop without prior notice and shall not be liable for resulting damages.
Article 14 (Disclaimer)
1. The Company shall not be liable for the following damages:
(1) Delays or interruptions caused by communication failures or force majeure events
(2) Delays due to customs processes or courier-related issues
(3) Damages caused by user negligence or usage environment
2. The Company’s liability for damages shall be limited to the amount paid by the user for the relevant order.
Article 15 (Compensation for Damages)
If a user violates these Terms and causes damage to the Company, the Company may claim compensation from the user.
Article 16 (Governing Law and Jurisdiction)
These Terms are governed by Japanese law. Any disputes arising in connection with these Terms shall be subject to the exclusive jurisdiction of courts located within Japan.
Article 17 (Language)
If there is any inconsistency between the Japanese version and translated versions of these Terms, the Japanese version shall prevail.
Supplementary Provision
These Terms shall take effect on December 10, 2025.
